ALABAMA WORKERS' COMPENSATION

Job injuries are exceptionally stressful. You are hurting, trying to recover, being treated by medical professionals you did not chose, and aren't being paid your full wages. You may be threatened with termination or have already been terminated. You may not ever be able to return to your previous line of work or, even worse, any kind of work at all. Injuries resulting in death are especially difficult for working families.

The Alabama Workers' Compensation Act is specific to injuries incurred on most every job in the State of Alabama including occupationally related diseases and death. When it was enacted, the Legislature determined that there should be a trade-off. In exchange for medical treatment and (in theory) quick payments for temporary and permanent injuries employers were given immunity from ordinary law suits like the kinds filed for auto accidents and slip-and-fall injuries.  Unfortunately, far too often employees do not receive the workers' compensation benefits that they are entitled to receive under the Alabama Workers' Compensation Act.

Retaliatory Termination

Employers cannot terminate an injured employee for filing a claim for workers' compensation benefits. Retaliatory terminations subject employers to damages for both compensatory and punitive damages. Typically, retaliatory terminations are for some pre-textual (false) cause so as not to appear blatantly retaliatory or the employer simply makes employment so miserable the employee quits. Either are still considered retaliatory and are actionable as a separate suit by the employee aside from their workers' compensation suit.

You need an experienced workers' compensation attorney to represent you. Workers' Compensation cases require specific knowledge of the Alabama Workers' Compensation Act, an understanding of the science and medicine of your injuries, and the litigation experience to effectively work the courtroom for the best result in your case. I have represented hundreds of injured workers across the State of Alabama, especially in Shelby County and the Birmingham metro area, and have published journal articles on workers' compensation topics.
