ALABAMA WORKERS' COMPENSATION

Retaliatory Termination
Employers cannot terminate an injured employee for filing a claim for workers' compensation benefits. Retaliatory terminations subject employers to damages for both compensatory and punitive damages. Typically, retaliatory terminations are for some pre-textual (false) cause so as not to appear blatantly retaliatory or the employer simply makes employment so miserable the employee quits. Either are still considered retaliatory and are actionable as a separate suit by the employee aside from their workers' compensation suit.
